New release: a benchmark of 3 European regulations on corporate sustainability against both the OBP and Social+ OBP Standards.

Consumer awareness and concerns to understand what is “behind” the products they buy, and whether there are possible unethical practices in their supply chains are growing. In response, governments, especially in Europe, are adopting due diligence directives or laws for companies. These establish legally binding obligations to identify and prevent adverse impacts resulting from their activities and operations throughout their supply chains. In other words, corporate accountability in a globalised economy.

These new regulations ensure that investors and other stakeholders have access to the information they need to assess to measure the impact of companies on people and the environment, and subsequentially, assess financial risks and opportunities arising from climate change and other sustainability issues. These regulations also ensure the identification, monitoring and remediation of possible human rights and environmental risks by companies.

The absence of developing a plan to address these requirements, or faults in the plan´s implementation, empower potentially affected people to hold companies accountable and exposes the company involved to penalties, fines or other punishments.

Within the strategies implemented by companies to ensure compliance with such regulations, a very common practice is to have their supply chains comply with internal or external standards. Due to the variety of regulations and supply chains, companies may need to analyse and rely on multiple standards to match the requirements. To facilitate this work in the area of using certified recycled Ocean Bound Plastic as raw materials, ZPO has revised 3 different European regulations:

The EU Directive on Corporate Sustainability Due Diligence 2024

The French Corporate Duty of Vigilance Law 2018

And the German Act on Corporate Due Diligence Obligations in Supply Chains, 2023,

to benchmark the specified risks established in each of these 3 regulations, and how they can be addressed if using OBP and Social + OBP[1] material in their supply chains.

Each of the three regulations analysed have their particularities regarding: (i) whether an Organization falls within the scope of requiring to comply with the specific regulation or not (depending on nature/geography/size/operations), (ii) how they should establish and implement their plan and procedures, and the extent to which they should address prevention, correction and monitoring of determined risks, and, (iii) the type of penalties, procedures, and periods for correction in cases of non-compliance with some aspects of the regulation. These aspects fall outside the scope of our benchmark and need to be revised in detail by interested organizations. We do attempt however to address in detail the identified environmental and social risks established in each of them, and how our standards can help minimise risks.

[1] Social + OBP is particularly efficient addressing ethical and social risks for recycled plastic because it is the only program that includes informal waste pickers within its certification scope, which is the first step in the recycled plastic supply chain.

HIGH LEVEL OVERVIEW OF COVERAGE

The below graphics provide an overview of how many requirements present in the directive or laws are also addressed in the OBP or Social+ OBP Certification. For each you will find a more detailed benchmark in the annexes of the document available for download at the end of this post.

Note: Most of the environmental factors addressed in the laws or directive are not relevant to plastic collection or recycling, so the coverage of OBP certification is naturally low.

EMPOWERING WASTE PICKERS THROUGH THE
SOCIAL+ OCEAN BOUND PLASTIC CERTIFICATION

Zero Plastic Oceans is excited to announce the launch of the first social certification focusing on the cornerstone of the circular economy supply chain: the waste picker community. This new certification component, called Social+ Ocean Bound Plastic, aims to support organizations that step further from business as usual and engage with waste picking communities and employees in a fair and ethical manners.

This is the first social certification specifically designed to include informal waste pickers and provide them direct benefits, tailored to their needs and specific situation.

The Social+ OBP certification will empower communities and individuals by ensuring businesses create inclusive and equitable working environments and support them along towards better living conditions.

What does the Social+ OBP certification entail for informal waste pickers?

Effective strategies and practical solutions to ensure child protection and prevent child labor.

Strengthened bargaining power and enhanced representation within the organization.

Enhanced Occupational Health and Safety measures for a safer working environment.

Support with administrative and financial tasks in daily life.

Accessible and actionable training programs for personal and professional growth.

Enhanced income stability with transparent and verifiable payment records and enforced premium payments.

Who can apply to this certification and make Social+ OBP claims?

The Social+ OBP certification is available to all organizations involved with the first step of collection of Ocean Bound Plastic. It is applicable for both Commercially Recyclable and Non-Commercially Recyclable OBP hence for both subprograms of the OBP Certification Program. To engage in this certification process, interested organizations can contact any of the approved certification bodies.

Social+ OBP claims can be made throughout the value chain if the initial collection step is Social + certified and the rest of the value chain is OBP certified.

How was the Social+ OBP certification drafted and developed?

After 3 years of implementation of the Ocean Bound Plastic certification, it became obvious that there was a significant opportunity to improve social rights and human rights along the OBP value chain and in particular for waste pickers who need it the most.

As a result, Zero Plastic Oceans started a multistakeholder consultation process to draft the first version of the standard. This first version was then developed with the help of a community of practice composed of brands, projects, certification bodies and other entities (Ranong Recycle For Environment/Tide Ocean (Thailand), The Good Idea, OceanCloud, Groupe Rocher, BVRio, Control Union, Seven Clean Seas, Ecoblue, GIZ China). The revised draft was then published for public consultation and the comments incorporated into the final version of the standard published on the 8th of September 2023.

What are the benefits for the certified companies?

By obtaining the Social+ OBP certification, you can demonstrate your social commitment to go above and beyond when working with waste picker communities and your own employees, while supporting an inclusive circular economy with positive environmental impact practices. You will not only be protecting the environment, but above all, transforming the lives of individuals that need it the most through a holistic approach and measurable impact.

Pinnacle Fiber became the first company to obtain the Ocean Bound Plastic Certification in Pakistan, both for Collection and Recycling of OBP. Ali Akbar, in charge of Business Development tells us a bit more about their motivations through this interview

Could you describe Pinnacle Fiber?
Pinnacle Fiber (Pvt) Limited is a Pakistan-based regenerated polyester company, specializing in polyester staple fibers made from recycled, post-consumer PET plastic bottles. Our commitment is to high-quality textile production through environmentally-friendly manufacturing. We have the vision to reduce the dependence on natural resources, and produce a variety of quality renewable products, and contribute to an environmentally-friendly economy. And our mission is :

Reuse waste and conserve natural resources

Use state of the art recycling technologies

Expand and diversify our recycling capabilities.

Why is the Ocean Bound Plastic certification important for your company?
sea, shore-lines, rivers, water way plastic free and indeed be known for it! We tend to lead by example. Waters are not for industrial dump their protection is our responsibility

How does this certification helps support your company´s environmental policies?
We intend to demonstrate leadership by action. This certification is testament of our core values and our objective is to manufacture environmentally friendly products. This includes collecting waste from where it matters: our vast oceans, coastlines, beautiful lakes, rivers, waterways and majestic mountains.! By being the first we hope to lead and promote the Pakistani business community move towards sustainable practices.
To manage, rescue, reuse and reduce this plastic waste and transfigure it back into the economy with new life diverting it from oceans and waterway is the example we aim to set for all life-sustaining products.

What challenges did you face in preparing for audit?
Waste management is an undeveloped, neglected and informal sector in Pakistan due to an absent municipality and the fragmented nature of rag picking. Therefore, developing and educating registered and compliant ragpickers and incentivizing them towards waste picking from high-priority ocean bound zones was a challenge.

How long did it take for your company to get certified?
The process took 8 months, and this long-haul time frame is attributed to two factors: Pinnacle Fiber is the first organization in the country to be OBP which meant a lot of back and forth was done in understanding the finer points for the audit. Second the rigorous demands of the audit itself meant making preparations and changes on an operational level to be fit to meet the certification criteria. These include, trainings, logistics, health and safety and registration compliances.

What benefit are you expecting to get from the OBP certification?
Market Leadership. Being the first we are setting the bar.

What advice would you give to other organizations applying for the Ocean Bound Plastic certifications?
Do it! The more the merrier. If we all keep streamlining the process and following sensible guideline and adding economics to recycling the whole industry becomes a matter of fact for everyone. Corporations that benefit from an ocean free plastic will translate to cleaner beaches and much a much happier marine life. Governance, cooperation’s and individual all levels must contribute positively to the Earth that cradles us

The Ocean-Bound Plastic Certification from Zero Plastic Oceans signals to our partners and stakeholders that our efforts to reduce ocean-bound plastics are certified, audited and sustainable,” said Ocean Recovery Group President, Zachary Kirstein. “We are proud to bring recycling infrastructure to the Dominican Republic, a country currently only recycling 8% of its waste.

Ocean Recovery Group’s La Vega, Dominican Republic, facility boasts state-of-the-art processing equipment including a 2-ram Max Pack Baler, 7 Vertical Balers and 2 complete plastics lines including a friction washer, shredders, sink tanks, steamers and pelletizers. The facility, which began processing in February 2022, also separates and bales PET, HDPE (natural and color), PP and LDPE plastics as well as cardboard and paper-grade recyclables. In 2022, Ocean Recovery Group’s integrated-recycling operation goal is to collect, recycle and neutralize 12,000 Tons of ocean-bound plastic.

Control Union is proud to have served as certification body to Ocean Recovery Group in their Ocean Bound Plastic journey,” said Gabriela Santos, Program Coordinator at Control Union. “Besides their important recycling activities in the Dominican Republic – Control Union appreciates how Ocean Recovery Group has remained readily available and transparent during the full certification process.

The Ocean-Bound Plastic (OBP) Certification is designed to encourage the removal of Ocean Bound Plastic from the environment by adding value to effectively collecting and treating it to prevent it from reaching the ocean. To achieve the certification, applicable organizations must first prove: OBP plastic waste is collected adequately and ethically; OBP plastic waste is well managed once collected; commercially recyclable OBP waste is traceable until the final product; and, non-commercially recyclable OBP waste is correctly handled, and are thoroughly verified and traceable. In addition, OBP-certified organizations guarantee the respect of social criteria, including a commitment to no child labor, safe working conditions and fair wages for recycling collectors.

Zero Plastic Oceans welcomes the certification of Ocean Recovery Group to the Ocean Bound Plastic standards for the collection, recycling and neutrality value chains,” said Vincent Decap, Co-Founder of Zero Plastic Oceans. “By choosing to certify these value chains, ORG will bring a concrete solution to the Dominican Republic for both commercially recyclable and no value plastic at the same time, ensuring a cleaner environment and enhanced social benefits to the waste picking communities.

About Ocean Recovery Group

Ocean Recovery Group is working to solve the planet’s ocean-bound plastic crisis in the Western Hemisphere. Our extensive knowledge across the recycling and packaging industries, paired with our commitment towards greater good, enables Ocean Recovery Group to effectively and efficiently divert large and scalable amounts of ocean-bound plastics to help CPG retailers achieve their plastic neutrality goals.

About Zero Plastic Oceans

Created in 2019, Zero Plastic Oceans is a non-governmental organization (NGO) dedicated to addressing plastic pollution issues. The organization was born from the observation that most plastic waste ending up in the ocean comes from abandoned plastic waste, the so-called “Ocean Bound Plastic” (OBP). ZPO has set the Ocean Bound Plastic certifications as a mean to incentives the collection of OBP for its recycling or proper disposal.

Over the last year, Zero Plastic Oceans and Control Union teamed up to control and certify 9 companies in India, making it the country having received the highest number of Ocean Bound Plastic (OBP) certifications. This great interest in OBP certifications reflects the regional willingness of industries and NGOs to take action against plastic pollution.

One year after the launch of the OBP certifications, 9 Indian companies have been certified, of which 5 applied to the OBP recycling standard and 4 to the OBP collection standard. Granted for one year, the certifications assert the proper collection and management of Ocean Bound Plastic, as well as its recycling into new products.

Some certified companies are integrated collectors, recyclers & convertors of recycled materials to packaging & products, like Lucro (recycled LDPE, LLDPE, PP & HDPE) and Dalmia Polypro (recycled PET and recycled polyester fibers) some are dedicated to collection only like Plastic for Change and some are focused on the transformation of recycled material into products like Polygenta Technologies (recycled yarn), Alliance Fibres (recycled fibers) or Mon Export (bags and accessories).

Through this growing diversity of actors India can offer fully certified end products from Ocean Bound Plastic.

The need to do our bit to stop the flow of plastic into our oceans made us seek out for this OBP certification which was very thorough in evaluating our supply chain right from sourcing of Ocean bound plastic to final conversion of recycled granules to product. The intensive audit also verified our traceability across the supply chain & inspected fair trade policies such as the absence of child labour, fair treatment/payments to employees & waste-pickers. We have been collecting about 10 mt of ocean bound plastic waste every month since the certification & converting most of the waste to recycled resin & products such as PP rafia bags & garbage bags. We hope that going ahead this certification will help us enable a number of brands to replace virgin plastic with ocean-bound recycled plastic- thereby help them become more sustainable, explains Varun Karasia, CEO of Lucro.

Since 2016, India has stated its will to “give thrust on plastic waste minimization, source segregation, recycling, involving waste pickers, recyclers and waste processors in collection of plastic waste”. To implement this project, various initiatives have been settled such as the prohibition of imports of solid plastic waste and awareness campaigns on single use plastics.

However public policies are not sufficient to reduce the amount of plastic waste in the country. According to the National Central Pollution Control Board, the country is generating around 26,000 tonnes of plastic waste a day, out of which 60% of plastic produced is collected. The 40% left is mismanaged, open air burned, in nature and drifting in rivers and oceans.

The OBP certifications provide an easy tool to promote the removal of Ocean Bound Plastic from the environment. They complement governmental directives, allowing private or associative actors to be recognized for their commitment, explains Vincent Decap, Co-founder of Zero Plastic Oceans.

A sustainable management of waste through community empowerment and multi-stakeholder approach, is necessary for ocean preservation. Through the Ocean Bound Plastic certifications, communities and industries are given the opportunity to address urgent gaps in plastic waste management.

Control Union and Zero Plastic Oceans are launching a new component to their Ocean Bound Plastic (OBP) certification program. Initially designed to encourage the recycling of OBP, this program has been reinforced by the introduction of a label promoting the collection and proper disposal of non-recyclable OBP. Two certification subprograms are now available: the “Recyclable Ocean Bound Plastic Certification” and the new “Ocean Bound Plastic Neutrality Certification.”

The new certification subprogram is a Plastic Neutrality model where different companies, using or producing plastic, will be able to compensate their plastic footprint by purchasing neutralization certificates. The neutralization certificates (plastic credits) are emitted by organizations specialized in the collection and treatment (through disposal or valorization) of non- recyclable OBP waste. The sub certification program includes two standards guaranteeing the respect of the whole neutralization chain. The first standard is applicable to companies willing to compensate their plastic footprint and to become “OBP Neutral”. The second one is applicable to organizations collecting and treating non-recyclable OBP for which they issue neutralization certificates.

Audits are peformed by independent certification bodies and each neutralization certificate is verified and publicly registered to ensure transparency, traceability and reliability of the compensation system.

The OBP Neutral Label ensures consumers and certification holders that:

Vincent Decap, Co-Founder of Zero Plastic Oceans explains: “Reducing marine plastic pollution means acting on all levers: Reduce, Substitute, Recycle, Dispose, Mismanaged. Extending the scope of our Ocean Bound Plastic Certification program is a way to tackle both the Recyling and Mismanaged Waste challenges. By delivering two complementary certification subprograms, one focusing on recyclable plastic and the other one on non-recyclable plastic, the collection of all type of plastic waste is encouraged. Thus, the Ocean Bound Plastic certification promotes a complete job which really make a difference for wildlife and the environment”.

Heng Hiap Industries, based in Johor (Malaysia), is the first company to obtain the Ocean Bound Plastic (OBP). This certification outlines Heng Hiap Industries’ best practices and commitment to collect Ocean Bound Plastic with the final aim to recycle it into eco-friendly products.

Heng Hiap Industries was awarded on the 31st of August 2020, the Ocean Bound Plastic Certification for its OBP Collection system and for its OBP Recycling system becoming the very first company to be third party certified for Ocean Bound Plastic collection and recycling worldwide! With 17 years of experience in the plastics recycling industry, Heng Hiap Industries is setting the new standard for the plastic recycling industry involvement in reducing marine pollution.

In Malaysia, plastic pollution issues have been a major concern over the last years. In 2018, the country became the main alternative destination for plastic scrap – after China banned imports of such waste – and started dealing with influx of garbage[1]. As a matter of fact, launching the project in this region was relevant and embodies a great example of how circular economy can be implemented on a local scale.

To obtain the Ocean Bound Plastic Certification, Heng Hiap Industries was audited by the independent certifying body Control Union against Zero Plastic Oceans’ OBP Collection Organization Standard and OBP Recycling Organization Standard. The audit included the evaluation of places where the OBP was collected and how it was then recycled, an evaluation which guarantees traceability and integrity. It also covered very important social and environmental requirements like the absence of child labor, the fair treatment of employees & waste pickers and the respect of international best practices in waste management.

Heng Hiap Industries certification is valid for one year during which the company will be able to supply fully certified 100% Recycled OBP pellets of PP, PET and PE. Following this year, a new audit and evaluation will be carried out to renew the certification.

Zero Plastic Oceans and Control Union newly released Ocean Bound Plastic certification is now featured in Ubuntoo’s database as a solution against plastic pollution and for sustainable fashion.

This new certification for Ocean Bound Plastic is transparent thanks to published standards and third party audit. We trust it will support greater clarity in the recyclable Ocean Bound Plastic market for brands and customers and overall help reduce the plastic waste reaching our oceans.

Transparency is important when talking about a new a fashionable market like the Ocean Bound Plastic or Ocean Plastic markets. First of all to enable consumers to differentiate between Ocean Plastic which come from marine litter collect in the sea (floating plastic, or gosht nets most usually) and Ocean Bound Plastic that is at risk of getting carried away into the ocean.

Ocean Bound Plastic has a relatively ample definition since most people agree that it is abandoned plastic waste within 50km form the coast. However in practice many organizations collecting this Ocean Bound Plastic do it with an aim of protecting oceans and focus on much closer to shores or river plastic.

Additionally in the certification developed Zero Plastic Oceans has created 3 categories of Ocean Bound Plastic, 2 of which are very close to the shore and rivers. These categories are called Shoreline OBP and Waterways OBP, they focus on abandoned plastic waste within 200m from shores and rivers so that the environmental impact of buying this categories is a lot greater. you can read some more here.

On the occasion of World Oceans Day, Control Union and Zero Plastic Oceans are joining forces to launch the world’s first third party verified label to avoid Ocean Bound Plastic (OBP) waste reaching marine environments: The Ocean Bound Plastic Certification. Based on international environmental standards and label best practices, this certification aims to capture OBP – plastic abandoned in the natural environment bound to end up in oceans – while rethinking the plastic value chain.

To celebrate 2020 World Oceans Day (June 8th), Control Union and Zero Plastic Oceans innovate for a Sustainable Ocean and are introducing together the world’s first third party verified Ocean Bound Plastic Certification. The certification covers collection and recycling of abandoned plastic waste near rivers or shores, known as Ocean Bound Plastic (OBP)1 before it becomes ocean plastic pollution.

80% of ocean plastics comes from land-based sources and a large percentage is plastic waste abandoned in areas where – due to rainfall, tides, and winds – is bound to be drawn to oceans (shores, riverbanks and rivers). OBP is the major source of ocean plastic pollution and collecting it is the most efficient and economical urgent solution to this major environmental issue.

Aimed at private companies, NGOs and financial supporters, this unique certification is a direct and effective way to address the challenges of the Sustainable Development Goal 14 (“Conserve and sustainably use the oceans’’). The program has been conceived in a global manner, compliant with local and regional regulatory frameworks, making it rapidly implementable and providing visible results in the short term.

The Ocean Bound Plastic Certification relies on three pillars:

Collecting OBP focusing on critical areas;

Ensuring the proper management of collected OBP (recycling, and/or valorization and/or correct final disposal);

Increasing the stream volume and value of recycled OBP plastic.

The Ocean Bound Plastic Certification program is available for a wide range of stakeholders, private companies, authorities and NGOs that can be collectors, traders, recyclers, polymer manufacturers, packaging manufacturers or producers of plastic products. This certification is intended for any organization willing to support the collection and incorporation of OBP plastic into their products.

“At Control Union, we are taking action to support a resilient and safe ocean, in line with our policy of supporting environmental standards and certifications. The Ocean Bound Plastic Certification is based on environmental and social requirements and a full verification of the chain of custody for the collection and recycling of OBP until the final product. The standard set by Zero Plastic Oceans is a new step towards transparency and quality in the field of OBP recycling and valorization. This OBP label is a key tool to reduce ocean pollution and give certainty to final consumers that they are purchasing a product that really helps the oceans,” explained Robert Demianew, Vice President for North America.

The NGO Zero Plastic Oceans has conceived a model called ZPO Initiative, based on the use of the OBP certification. In this model, certified companies belonging to the plastic industry mandate NGOs -which will also be certified – to manage the OBP collection on their behalf. Once OBP collection is carried out, the recyclable portion of collected plastic is sold to recycling companies giving it a second life, while the non-recyclable portion is correctly valorized or properly disposed. This Initiative is aiming at turning off the tap on marine litter by giving the plastic industry an efficient and low-cost tool to implement rapidly.

“This certification is not only an environmental label certifying the origin and chain of custody of OBP for the recycling market; if used widely by the plastic industry, it is also a powerful tool to reduce marine contamination caused by plastic waste mismanagement. We all know that oceans are under great threat from plastic pollution while 40% of the global population directly depends on the ocean making it urgent to take actions. This label is an opportunity to implement an inclusive solution where everyone; industry, NGOs and consumers, play a key role” Said Vincent Decap, Zero Plastic Oceans Co-Founder.

The Ocean Bound Plastic Certification program has been developed in collaboration with companies from the recycling market like Oceanworks (International OBP sale platform) or Heng Hiap Industries (Malaysian plastic recycling leader), and other NGOs involved in ocean protection. The program is open for applications and all relevant information can be found on the website www.obpcert.org.

Recolección de OBP con enfoque en áreas críticas (ríos, riberas de ríos, costas);

Gestión final adecuada del OBP recogido (valorización y/o reciclaje y/o disposición final correcta);
